1.    Information and Policy scope.

EDITIDE LLC (“editide,” “Company,” “we,” “us,” or “our”) is committed to respecting the privacy rights and concerns of all users (“you”) of the services made available by editide. This Privacy Policy applies to the users of Company’s software in object code and our website (the “Service''). We have established and implemented this Privacy Policy to inform users of the Service of how we use and protect the information we collect through the Service, that may include personal data as defined by applicable laws and regulations. Please note that some privacy rights and obligations may differ in certain locations based on local law, in which case we will comply with the local legal requirements

By using the Service, you consent to editide's collection, use, storage, processing, and deletion of information relating to you as outlined in this Privacy Policy. This Privacy Policy is effective as of the date set forth above and is only applicable to the Service. We reserve the right to modify this Privacy Policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this Policy, we will notify you here that it has been updated.

2.    Controller and Processor of your personal data.

Your personal data will be processed by the Controller and/or Processor. A Controller is a natural or legal person or public authority which determines the purposes and means of the processing of personal data. A Processor is a natural or legal person or public authority which processes personal data on behalf of the Controller. When you use our Service we are the Processor of the data you submit. When you link to technology, software, and services owned and controlled by third parties (“Third Party”), the Controller of your personal data is the Third Party.

2.1.    Third Party privacy policies.

We use third-party services from Keygen for license activation and validation, Stripe for payment processing, Wix for web hosting, DigitalOcean for cloud storage, and Microsoft for communication and productivity. This Privacy Policy does not cover the information practices of third-party vendors accessed through the Service. Although we choose third parties obligated to protect your personal data, we are not responsible for their collection and use of your personal information. You should refer to the privacy policies and statements of their websites or contact the respective webmasters of those websites to obtain information regarding their information collection, use, and disclosure practices.

3.    Personal information storage and processing location.

To provide you with access to our Services, your personal data is collected and used by editide, which may include EDITIDE LLC, its partners, or its affiliates for particular Services or in specific jurisdictions. Your information, including personal data, is processed at editide's operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to — and maintained on — computers located outside of your state, province, country, or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

The Company will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your personal data will take place to an organization or a country unless there are adequate controls in place including the security of your data and other personal information.

4.    Information we collect.

When editide collects your personal data, it is only collected for an appropriate lawful reason. We use, process, and share it only for the purposes for which it was collected, which include:
(i)    Delivering our Service and associated installation files.
(ii)    Communicating important notices such as information about purchases, and changes to our terms, conditions, and policies.
(iii)    Communicating changes to our Service such as software updates.
(iv)    Handling your support requests and queries.
(v)    Processing payments.
(vi)    Requesting feedback.

You give us your express consent to use your personal data in connection with the performance of our Service as set forward in this Privacy Policy.

To access our Service, you might provide us with your personal information, or it can be automatically collected.

4.1.    Information you provide to us:

(i) Your name and email address: We will use this information for communication purposes. We may collect information from you if you request additional information regarding our Service or receive customer support.

(ii) Your payment card and other payment method information: We may need your payment credit card information in order to make the payment of your order in a faster and secure way. editide will not access or store this information. Stripe will serve as a data Processor when processing your payments for our Service. Stripe uses secure payment processing, according to Payment Card Industry Data Security Standard (PCI DSS).

If you give editide the personal information of another individual, then you are solely responsible for complying with all applicable laws, including obtaining the individual’s valid consent, regarding your collection and disclosure of the personal information to editide and to editide’s use, disclosure, and retention of the personal information.

4.2.    Information we collect automatically:

We may collect certain information automatically when you use our Service, such as your Internet protocol (IP) address, device and advertising identifiers, browser type, operating system, Internet service provider, the date and time of your visit, information about the links you click, the pages you view, the general manner in which you use our website, and other standard server log information. We may also collect certain location information when you use our website, such as your computer’s IP address, your mobile device’s GPS signal, or information about nearby WiFi access points and cell towers.

We and third parties that provide content or functionality on our Service, may use cookies and similar technologies to automatically collect this information. For more information about cookies and similar technologies, please see the “Cookies” section below.

Our Service may be exposed to non-personal information and data of a confidential or proprietary nature stored within your Office workbooks, presentations, and documents. We do not collect this information.

We may also receive information about you from other sources, including through third-party services and organizations.

5.    Cookies.

We use Cookies and similar tracking technologies to track the activity on our Service and store certain information. Tracking technologies used are beacons, tags, and scripts to collect and track information and to improve and analyze our Service. The technologies we use may include:

(i) Cookies or Browser Cookies: A cookie is a small file placed on your device. You can instruct your browser to refuse all Cookies or to indicate when a Cookie is being sent. However, if you do not accept Cookies, you may not be able to use some parts of our Service. Unless you have adjusted your browser setting so that it will refuse Cookies, our Service may use Cookies.

(ii) Web Beacons: Certain sections of our Service and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of a certain section and verifying system and server integrity).

Cookies can be "Persistent" or "Session" Cookies. Persistent Cookies remain on your personal computer or mobile device when you go offline, while Session Cookies are deleted as soon as you close your web browser.

6.    Children’s privacy.

We do not knowingly collect personal information from children under 13 nor allow them to access the Service. We take children’s privacy very seriously and encourage parents to always play an active role in their children’s online experience.

7.    Personal data processing times.

We will keep your Personal information for as long as it is necessary to fulfill the purpose for which it was collected according to Section 4 or to comply with legal and regulatory requirements. If you wish to have any Personal information removed from our databases, you can have it removed in accordance with Section 10. Deletion of Data shall be performed in a manner that is compliant with General Data Protection Regulation.

8.    Security measures to safeguard your personal information.

We take reasonable precautions to protect personal data from loss, misuse, unauthorized access, disclosure, altercation, and destruction. Unfortunately, while we work hard to ensure the security of your personal data while it is on our systems, no security measures are perfect, and data transmitted over the Internet is not guaranteed to be 100% secure. We cannot and do not ensure or warrant the security of any personal data you transmit, and you do so at your own risk.

9.    Sharing your personal information.

We restrict the access of Personal Information to editide’s employees, independent contractors, and agents who need to know that information in order to develop, operate and maintain the Service. Once we receive a transmission from you, we will endeavor to maintain its security on our servers.

The personal information uploaded by you through the Service will be shared with authorized people to whom you specifically grant access, as follows:
 
(i) editide’s affiliates, partners and other related companies for the purposes listed in Section 4.

(ii) Service providers and business partners for the purposes of operating our business, delivering, improving, and customizing our products or services, sending communications.

(iii) Outside editide or its partners, we may transfer personal information to third parties to complete the purposes listed in Section 4. Third parties may include governmental entities requests, such as a court order or a request by law enforcement or governmental authorities. We may also share personal information if such action is appropriate to enforce our Terms of use for the Service, including any investigation of potential violations thereof, when such action is deemed necessary to detect, prevent, or otherwise address fraud, security or technical issues associated with the Service, or when such action is appropriate to protect the rights or property of editide, its employees, users of the Service or others.

editide does not now, nor will it in the future, sell, rent, or lease any of its customer lists and/or names to any third parties.

10.    Knowing your rights.

We strive to make sure that our information about our customers is reliable, accurate, and up to date. You have rights concerning personal information about you, as follows:

(i) Right to be informed: You have the right to receive information about what data we capture, process and store about you, this information may include the categories or specific types of personal information we have collected; the purpose for collecting or disclosing the information; the sources from which personal information was collected; among others.

(ii) Right of access: You have the right to ask us to rectify personal information that you think is inaccurate. This also includes the right to ask us to complete information you think is incomplete or outdated.

(iii) Right to deletion: You have the right to request deletion of your personal data that is being stored by us. Please keep in mind that we cannot delete any data that we process to fulfill contractual or legal obligations.

(iv) Right to data portability: You have the right to request to port your data to a similar service to the extent this is technically feasible.

(v) Equal service and price: You have the right not to be discriminated against when you exercise your rights, we will not deny you goods or services, charge a different price, impose penalties, provide a different level or quality of service, or suggest a different price or rate or different level or quality of goods or services in order to ensure we provide an equal service and price to all customers.

(vi) Opting out of receiving communications from us: If you no longer want to receive our emails, or other announcements, you may unsubscribe by writing to us at support@editide.com. Please note that you cannot unsubscribe from certain correspondence from us, including messages relating directly to your subscription.

10.1.    Exercise your rights

You may update or request rectification or deletion of your personal information or exercise of any of your rights regarding your personal information when treated by editide by writing to us at support@editide.com. Additionally, you may have the right to access the privacy shield data that we hold about you. If you would like to request access to your privacy shield data, you can submit a written request to support@editide.com. We may request specific information from you to confirm your identity.

11.    Mediation.

You agree that, in the event, any dispute or claim arises out of or relating to this Privacy Policy, you and editide will attempt in good faith to negotiate a written resolution of the matter directly between the parties. You agree that if the matter remains unresolved for forty-five (45) days after notification (via certified mail or personal delivery) that a dispute exists, all parties shall join in mediation services with a mutually agreed mediator in an attempt to resolve the dispute.
